TERMS AND CONDITIONS (GTC)
1. Scope
These General Terms and Conditions (GTC) of Geraldine Khakshouri Consulting / muse-BEAUTY.com, Alte Zürichstrasse 6, CH-8118 Pfaffhausen (hereinafter referred to as the provider ) regulate the rights and obligations in connection with the use of the website muse-BEAUTY.com and the online -Shops on this site. The General Terms and Conditions apply to sales contracts with private customers and companies that are concluded via the muse-BEAUTY.com website, as well as to sales contracts that are concluded in another way, e.g. by telephone, email or letter. Before concluding the contract, customers are asked to confirm the terms and conditions and have the option of downloading them.
These GTC apply exclusively. Conflicting, supplementary or deviating conditions require the express written confirmation of the provider to be valid.
The terms and conditions, the delivery and payment conditions as well as the data protection regulations can be adjusted from time to time.
2. Conclusion of contract
The order is made via the online shop of muse-BEAUTY.com and is confirmed by the supplier by e-mail. With this confirmation of the order, a contract is concluded between the customer and the provider. Orders placed are binding for the customer. This also applies to prepayment orders. The purchase contract is only concluded when the customer has paid the full purchase price.
The provider is free to refuse orders and to refuse to confirm them.
If an ordered product cannot be delivered despite confirmation, the customer will usually be informed within five working days. The provider is entitled to withdraw from the entire contract or from a part of the contract. The payment made will be refunded to the customer - without interest - and there will be no subsequent delivery of the products. Claims for non-delivery or late delivery are excluded. The delivered products remain the property of the provider until full payment has been made.
3. Information on muse-BEAUTY.com
Information about and images of products are presented on muse-BEAUTY.com. The provider points out that price and range changes as well as technical changes are reserved. All information such as product descriptions, illustrations, films, dimensions and other information are to be regarded as approximate values and do not represent any assurance of properties or guarantees. The provider endeavors to provide correct and complete information and information, but cannot guarantee this either expressly or tacitly .
The provider cannot guarantee product availability at the time of ordering. All information on availability and delivery times is provided without guarantee and can change at any time and without notice.
4. Prices
All prices are gross in Swiss francs (CHF).
Fees associated with the purchase (e.g. advance recycling fee) and handling costs are included. Shipping costs are charged extra depending on the order value and delivery location.
Customs charges and taxes are not included. These are levied on a country-specific basis and are payable in full by the buyer.
For packages not collected due to customs clearance or other reasons and which are returned to the shipper/provider, muse-BEAUTY.com reserves the right to charge the costs to the buyer.
Technical changes, errors and misprints are reserved. The provider reserves the right to change prices at any time. The prices published on the website on the order date apply to customers.
The conditions for promotions and discounts can be found under the relevant information.
5. Delivery
Delivery is usually within 2-4 working days plus the actual transport process. If a longer delivery period is necessary or if an article is no longer available despite a confirmed order, the customer will be informed of the situation at the latest after this period has expired. The payment made will be refunded or made available as a voucher.
As a rule, an order is sent as a whole, but the provider reserves the right to make partial deliveries in individual cases. In the case of partial deliveries, the provider assumes the additional shipping costs.
Product descriptions may differ slightly from the products on muse-BEAUTY.com. Such errors are reserved due to the manufacturer's range renewals. An exchange or claims for damages due to incorrect illustrations, texts and prices or late delivery are excluded.
6. Shipping
muse-BEAUTY.com primarily delivers in Switzerland and the Principality of Liechtenstein. Up to an order value of CHF 150 for deliveries to Switzerland and Liechtenstein, the customer bears the shipping costs of CHF 8.50. In addition, shipping is free of charge to the two countries (CH, FL) mentioned.
For deliveries to other countries, special shipping costs apply and the delivery will prolong due to distance and custom processing.
Vouchers are sent free of charge. The delivery time is usually 2-4 days plus transport time which is not in control of the seller.
The goods are sent by post to the address specified by the customer in the order. Benefit and risk are transferred to the customer upon dispatch. The provider is not liable for any damage that occurs during shipping and/or due to late arrival of the goods by the customer or third parties.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, the provider can dissolve the contract after notifying the customer of a complaint and setting a reasonable deadline and charge for the costs of the activities.
The customer is obliged to check the delivered goods immediately after receipt of the delivery and to notify the provider immediately in writing by letter or e-mail of any defects for which the provider guarantees.
Returns to the provider are made exclusively at the expense and risk of the customer. The customer must send the goods to the provider in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects.
If the supplier's examination reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer's guarantee, the supplier can charge the customer for the activities, the return or the possible disposal.
7. Right of Withdrawal
The customer is granted a right of withdrawal within 14 days of receipt of the goods. The revocation does not require justification. Exercising the right of withdrawal leads to a reversal of the contract. The customer must return the goods in their original packaging, unopened and complete with all accessories and together with the delivery note. Returns to muse-BEAUTY.com are made exclusively at the expense and risk of the customer. Any payment already made (with the exception of the delivery costs and the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us) will be refunded to the customer within 14 days, provided that the Provider has already received the goods back or the customer provides proof that he has sent the goods back.
The provider reserves the right to demand reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling or improper return and to deduct the loss in value from the purchase price already paid or to invoice the customer. Likewise, the provider can refuse the refund if the customer has not returned the goods within the cancellation period. The date of the return is decisive in this regard.
The same means of payment used by the customer for the original transaction will be used for the refund, unless expressly agreed otherwise with the customer. The refund will be made without deduction of expenses.

8. Warranty
For reasons of hygiene, it is not possible to exchange or return opened, broken or used products. If you have any questions about an item, please contact us before purchasing, we will be happy to advise you. muse-BEAUTY.com endeavors to deliver goods of impeccable quality. If the delivered goods deviate from the order or have defects, the provider must be informed within 3 working days by e-mail. After 3 days, the goods are considered accepted without objection. The customer must then return the goods within 1 week. It is at the discretion of the provider to provide the guarantee through an equivalent replacement or through a refund of the purchase price. Further claims are excluded.
The warranty does not cover normal wear and tear and the consequences of improper handling or damage by the customer or third parties or by the post when shipping, as well as defects that can be attributed to external circumstances.
It is not possible for the provider to give any assurances or guarantees for the topicality, completeness and correctness of the data or for the constant or undisturbed availability of muse-BEAUTY.com , its functionalities, integrated hyperlinks and other content. In particular, it is neither assured nor guaranteed that the use of muse-BEAUTY.com will not violate the rights of third parties that are not owned by the provider.
9. Liability
Geraldine Khakshouri Consulting / muse-BEAUTY.com assumes no liability for the handling, ingestion, application and use of the delivered items.
The customer is responsible for discussing known incompatibilities or possible incompatibilities or effects with a specialist or seeking advice before using the articles. Dosage or application recommendations listed on the articles must be taken into account. Should side effects or health restrictions nevertheless occur, the provider assumes no liability.
The provider also excludes any liability, regardless of its legal basis, as well as claims for damages against the provider and any auxiliary persons and vicarious agents. In particular, the provider is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the customer and third parties. A further mandatory statutory liability remains reserved, for example for gross negligence or illegal intent.
The provider only uses hyperlinks on muse-BEAUTY.com to make it easier for the customer to access other websites. The provider can neither know the content of these websites in detail, nor assume liability or other responsibility for the content of these websites.
The provider undertakes to ensure state-of-the-art security in systems, programs, etc. that belong to him and over which he has control, and to follow the rules of data protection.
Customers must ensure the security of the systems, programs, data and passwords that are within their sphere of influence.
The provider is not liable for defects and faults for which he is not responsible, especially not for security deficiencies and operational failures of third-party companies.
Furthermore, the provider is not liable for force majeure, improper action and disregard for the risks on the part of the customer or third parties, excessive stress, unsuitable equipment of the customer or third parties, unforeseeable environmental influences, interventions by the customer or disturbances by third parties (viruses, etc.), which despite the current safety precautions happen.
10. Payment
The payment options specified in the ordering process are available to the customer.
The provider reserves the right to exclude customers from individual payment options and/or to demand prepayment without giving reasons.
If the customer is in default of payment, the provider can charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder.
The delivered goods remain the property of Geraldine Khakhouri Consulting / muse-BEAUTY.com until full payment has been made .
11. Privacy
The data protection regulations of the provider apply, which can be viewed and downloaded on their website. They are an integral part of these GTC.
The provider may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. The data required for the performance of the service can also be passed on to commissioned service partners (logistics partners) or other third parties.
12. Applicable Law and Venue
Swiss law applies to these General Terms and Conditions, namely the provisions of the Swiss Code of Obligations.
The court at the domicile or registered office of one of the parties is responsible for complaints by a customer. The court at the domicile of the defendant party is responsible for complaints by the provider. The place of jurisdiction for business customers or legal entities is exclusively the seat of the provider.
The masculine form always includes the feminine.
13. Severability Clause
If a provision of these GTC or a purchase contract is declared void or legally ineffective, the remaining provisions remain unaffected and are to be interpreted as if the provision or agreement had been concluded without the invalid provision. The same applies to any loopholes in the regulation.
